Terms and conditions
for purchases in the shop on hofknecht.eu. This English version is a courtesy translation; the German version is binding. Further down: withdrawal policy and model withdrawal form.
1. Scope and seller
These terms apply to all contracts concluded through the shop at hofknecht.eu/shop. The seller is Markus Hofknecht, Benediktbeurer Ring 14a, 86929 Penzing, Germany, email Markus@Hofknecht.eu (“I” below). The shop sells licenses for downloadable software, currently SystemTrayMenu and LeMa Village.
The shop serves consumers and businesses residing or established in a member state of the European Union, in Switzerland or in Norway. Deviating terms of the buyer do not apply.
2. Conclusion of the contract
The products shown on the product pages are not a binding offer. On the order page you choose product and country, accept these terms and click “Order with obligation to pay”. The shop then takes you to the payment page of the payment service Stripe. Completing the payment is your binding offer. I accept it by sending you the order confirmation with the license by email; this happens automatically, usually within a few minutes.
Until the payment is completed you can correct your entries at any time or cancel by closing the page or going back in your browser. The language of the contract is German. I do not keep the contract text available for you; the order confirmation contains all order details and a link to these terms.
3. Prices and payment
All prices are final prices in euros. Under § 19 of the German VAT Act (small business scheme) no VAT is charged or shown. There are no delivery or shipping costs.
Payment is handled by Stripe (Stripe Payments Europe, Ltd., Ireland). The payment page shows the available payment methods. The amount is due with the order. The invoice comes as a PDF with the order confirmation.
4. Delivery
Once the payment is received you get the license file and a download link by email to the address you entered. For security the link is valid for a limited time. On the shop page “Send license again” you can get the license and a new link to the same address at any time.
System requirements are listed on each product page. Please check them before buying.
5. Rights of use
With the purchase you receive a simple, perpetual, non-transferable right to use the software for your own purposes on your own devices. The software keeps working without an internet connection; there is no expiry date and no online check.
The license file is personal and contains your name, your email address and the order number; the software shows “Licensed to <name>”. You may not pass on, sell, rent or publish the license file or the software. The license terms of the product apply in addition where shown on the product page. Statutory rights, for example under §§ 69d and 69e of the German Copyright Act, remain unaffected.
6. Right of withdrawal and voluntary refund
Consumers have a right of withdrawal as set out in the withdrawal policy below. A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code).
Independently of this, I voluntarily refund the full price if you write to me within 14 days of the purchase that you do not like the product. No reason is needed. With the refund your right of use ends; please delete the license file and the program.
7. Warranty and updates
The statutory rules on defects of digital products apply (§§ 327 ff. German Civil Code). I provide updates needed to keep the software in conformity with the contract for as long as you can reasonably expect them under § 327f. The easiest way to report a defect is by email.
8. Liability
I am liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where I have given a guarantee. For slightly negligent breach of an essential contractual obligation on whose fulfilment you may regularly rely, liability is limited to the damage typical for the contract and foreseeable. Otherwise liability for slight negligence is excluded. Please back up your data regularly; for data loss I am liable only for the effort that restoring it would have taken with regular backups.
9. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection of mandatory provisions of the country where you habitually reside. I am neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. Should individual provisions be invalid, the rest of the contract remains valid.
Withdrawal policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period expires after fourteen days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform me (Markus Hofknecht, Benediktbeurer Ring 14a, 86929 Penzing, Germany, email Markus@Hofknecht.eu, phone +49 160 97237493) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory. You can also withdraw with the button “Withdraw from contract” on the page hofknecht.eu/shop/widerruf.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, I shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which I am informed about your decision to withdraw from this contract. I will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Early expiry of the right of withdrawal
For a contract for the supply of digital content not on a tangible medium, the right of withdrawal expires once I have begun performance after you have expressly consented to performance beginning before the end of the withdrawal period, acknowledged that you thereby lose your right of withdrawal once performance has begun, and I have provided you with a confirmation of the contract on a durable medium (§ 356 (5) German Civil Code). In the shop you give this consent and acknowledgement with a separate checkbox before ordering; performance begins when the license is sent.
End of withdrawal policy
